HC relief for Railway Board in appointmnt to Member-Traffic post case
BANGALORE: In an important development, the Karnataka high court has
permitted the Railway Board to appoint Devi Prasad Pande to the post of
Member-Traffic.
However, a division bench headed by Justice D V Shylendra Kumar has said that the appointment will be subject to the outcome of the application pending before the Central Administrative Tribunal, Bangalore bench.
The bench also set aside the July 12 interim order of CAT for maintaining status quo.
"It would not in the larger public interest to keep the post vacant for a longer period as all commercial and operating activities of railways are under the control of Member-Traffic" Mohan Parasaran, Solicitor-General of India, who apepared on behalf of the Railway Board told the court.
As regards to to NC Sinha,GM, Secunderabad ,the applicant before CAT, the court was told that the CVC did not give clerance to his promotion either for appointing him as additional member or for making him as general manager a year later in 2012 adn at the same he is ineligible as he doesn't come under the cadre eligible for appointment to the post.
Sinha who is working as Chief Operation Manager at South Western Railway, Hubli had moved CAT seeking for a direction to the Railway Board to promote him to the cadre of General Manager and thereupon consider him for selection to the post of Member-Traffic. Sinha contends that Pandey is junior to him.
The CAT is scheduled to hear the application filed by Sinha on August 8.
